Legal Question in Civil Rights Law in California
My 18 l/2 year old son lives with a family and helps take care of their
three children for room and board. His lower back was hurting him
so the mother gave him one of her prescription pain pills.
A friend of the mother was visiting and was on probation when
the police came to test her. They also tested my son who told
them that he had taken a prescription medication. They took
him to jail and now he has a court date to see the judge. Are the
police allowed to test and arrest someone in their home that is over
18 who took a prescription drug that was given to him but has no
possession of illegal drugs and no record of drug use or abuse?
The mother was there at the time and verified everything and
showed the officers the prescription bottle.
