Abandonment of property
My 83 year old mother is estranged from her son, we have a pending investigation (withdrew $180,000.00 cash out of her bank account!) he had her empty out her garage (so he could save a whopping $200.00 a month storage fees!) to store 700 cases of action toys, just in from China. These toys were supposed to be stored only 2 months in there and put into the store by last February 2007, they are still in her garage. Legally what can she do with the items? We wanted to donate to Toys for tot, but are not sure if they have lead. We tested only 1, showed no signs of lead, there are 4 others in the line to still be tested. Legally can we dispose of these? What recourse could our brother have if we do?

for starters, file criminal theft charges. Then file a civil case for recovery of her money. Discuss with an attorney whether you can sell the property for as much as you can get. Feel free to contact me if you get serious about pursuing the civil remedies.
