Legal Question in Civil Rights Law in California

abstract of judgement negotiation

I received an abstract of judgement without being served . Should I file a motion to vacate judgement on the improper service? and Is it possible to negotiate settlement after judgement has been recorded? Thank you

Re: abstract of judgement negotiation

If you dispute that you owe the money, it would make sense to move to set aside both the judgment and default judgment, and have the presumed lien removed. Without doing so, you probably have no leverage to negotiate since the creditor holds all the cards. At the same time, if your income is limited, they might be willing to take a couple of lump-sum payments. Good luck.

Re: abstract of judgement negotiation

You either vacate the judgment or negotiate a settlement to keep plaintiff from levying on your assets. Feel free to contact me if you need legal help trying either.
