Legal Question in Civil Rights Law in California
I got arrested for having $7,000 in my purse and then got drug charges
In a car with a friend driving, we got pulled over for going too slow. The officers searched because the driver was on parole. They did not find anything to arrest us for but said the $7,000.00 in my purse was intent to commit a crime and took me to jail and charged me with intent to commit a crime of selling and transporting Marijuana. I was going to buy a car at the auction the next morning! With no drugs anywhere on us or in the car, my friend, who is on parole, was told to go, and I was taken to jail. I have NO record at all, and now I have 2 felony charges against me. When I was released on $20,000.00 bail, the officers would not give me any kind of paperwork stating the amount of money they had taken from my purse, and my purse was returned to me empty. I asked them several times for a receipt of the money they had taken from me, but could not get any results. Now I am being charged with sales and transporting Marijuana, which is not true, and I don't have court until the end of this month. That was all of the money I had to my name. I cannot get a bank account because of problems with my credit card purchases a couple of years ago, so I keep my money in my home. Is this legal?

Something is not adding up.
Why marijuana, was the friend on parole for this? What evidence do they have? Only the money? What does your release paperwork state? 2 Charges..one is intent to sell and one is transportation, correct? If so, they must have SOME evidence of possession.
If everything is as bogus and trumped up as you state then, of course it is not legal and of course you have a claim.
Unfortunately, you NEED representation. You CAN NOT do this alone...DON'T EVEN TRY!
Maybe it would be best if you called or eMailed me directly and more confidentially a bit more information so we can discuss this a little better.

If there are charges filed against you as stated, the money is the evidence, and should be listed in the charges. If it is not listed, something is very odd. Contact me if interested in getting experienced counsel for your defense of the charges, and for investigating the situation to recover your money.
