if a bank said i stole money when i didnt and put it on my background check can i sue them for that

Yes, you can sue them. That does not mean that you will win.

IF you can demonstrate a 'provably false' statement of fact was made about you to a third party, and you were damaged by that false statement, you you can sue. Proof through legally admissible and credible evidence is your problem. You need to assume the bank consulted their attorneys before doing so.
