Legal Question in Civil Rights Law in California

battery

i was beaten up when my kids step father came to my house & attacked me without warning. He's a martial arts expert & i'm disabled(severe traumatic brain injury). He was arrested by the police & told them some lie about me forcing my kids to smoke pot. Now the police won't release any info on the case. He was talked to by the police about 6 months ago for beating up my son. Which he lied about doing. But he bragged to many people how he beat up my son. When i asked him about it? He then hung up the phone & came over & beat me up. My drs. Say any blows to the head will cause more permanet brain damage. He's self employed & owns a 1,000,000 home. Can i usue him?

If you went to the doctor right after you were injured so that your imjuries were documented, this would be the best scenario for suing him for battery. Remember you have only a short time within which to file a lawsuit. Good luck!

Based on the information you provided, it sounds as if you have a claim for battery. Were there any witnesses to the beating? If not, that doesn't necessarily kill your case, but it makes proof more difficult.

Sure you can sue. If you have proof, and win, then the house becomes a source for collection.
