Legal Question in Civil Rights Law in California

California Constituion Artcle 1 section 31 a

Within Article 1 of the CA Constitution, under section 31, it states that The state shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.

Does this include sexual Preference. i am trying to appeal a class that is being tough on tolerence of gays and bi-sexuals. If no other class is given to show tolerence to race ethnicity or gender is this a violation of Artcle 1 Section 31. No, sect 31 probably does not. Civil Code sect 1102 might apply if you fit its description. Depends upon what "appeal a class" means.
