If somebody's tapping your cell phone, it's probably legal. Make sure your taillights are working.

A private party doing it is illegal, but it's up to you to prove it. If you can, then you have the basis for a legal action. Proof is tough to come by.

The government can do it pursuant to a warrant any time they are investigating a crime.
