Legal Question in Civil Rights Law in California
claiming insurance
I have full coverage. I hit a motorcyclist. He is in a serious condition. What are my rights as far as getting my insurance to pay for my medical bills? The policy I purchased does NOT cover his medical bill.

Re: claiming insurance
I find it hard to believe that if you had car insurance of any kind, that you didn't have 'liability' covering the other guy's injuries. That is the basic minimum insurance. I suggest you contact your insurance agent or company and clarify. If, instead, you mean that your policy limits were too low to cover ALL his bills and claims, that is different. Then, you are in trouble and will be subject to a suit and judgment for everything above what IS covered by your insurance.
IF you had 'med pay' on your car insurance to cover your med bills, then it will pay up to the policy limit, but many people ignorantly don't even carry that, or only put on the minimum $5k, which is seldom enough.
Re: claiming insurance
Your concern for your own medical bills after running over a motorcyclist is -- well, did you ever consider applying to law school? If you really have "full coverage" this will include the legally required "liability" coverage that will pay for bodily injuries you inflict on others. You might also have "uninsured motorist" coverage that could possibly cover your injuries.
Re: claiming insurance
Most policies will cover injuries that result for the insured's negligence, to the limit stated. Some low-cost policies are 15/30, meaning $15,000 per person injured per incident to a total of $30,000. Others have higher limits. Your insurance carrier should attempt to settle with the injured biker's insurance company within the limits to protect you. If you receive a lawsuit, immediately send a copy to your insurance company and ask them to defend and indemnify you. P.S. Mr. Stone has a wicked sense of humor, sometimes.
Re: claiming insurance
As always with questions like yours, I hope against hope that it is merely ill-phrased, and that what you meant to say is that a negligent motorcyclist hit you.
That said, you have every right to ask your insurance company to pay for your medical bills, within the coverage limits of your policy. The motorcyclist, just in case you are curious, has every right to sue you for every penny you have, and possibly a few you don't have, assuming he or she survives. If not, you'll likely be hearing from the executors of the estate.
I'd wish you good luck, but I have the feeling the motorcyclist could use it instead.
