Is the company liable???

I reside in California. i am currently in the process of moving to Arizona. On my first trip out of town, I left my vehicle in my driveway. A few days after I left, someone I know had another friend of ours who works for a tow company tow my vehicle out of my driveway. I know this because my neighbor saw them. He used his company vehicle to tow it, although he was not on the clock.Is the company responsible for the actions of their drivers while they are in a company vehicle whether they are on the clock or not? Can I sue them or the price of my vehicle?

Um, why do your think this individual towed your vehicle? What became of the vehicle? Was it damaged? Why do you describe this individual as your friend? Why did this other alleged friend "have" the tow-truck-driver "friend" tow the vehicle? Assuming this is not a repo or other lawful tow, I would sue everybody involved and let the courts sort it out.

You can sue anybody you like for anything. Winning is different. You may have a claim against the company in addition to the driver for your damages.
