Legal Question in Civil Rights Law in California

I ended up with a car the cant be smoged.

The person he purchaced it from said it was just a few hoses that needed to be fixed but the guy at the shop who is smoging it for me wants 1,700.00 to put it back together and he is not sure it will pass after still. Now the person who sold my bf the car is not returning our calls. If i sell the car to someone else w/o smog will i become legally responsible for the repair of the vehicle just like the guy who sold it to me is responsible now? In other words someone will be able to sue me for d- smoging the car just like i can do the the previous owner.

Every seller is responsible to provide a current smog cert upon sale to a buyer unless the car is sold as a 'non operating parts car', fully disclosing it doesn't have and may not pass a smog cert. If you didn't require a cert when you bought it, you now will have to demand the seller get you one, or you can sue in small claims court for the cost of repair, or the price of the vehicle, whichever is less. If you sell it now as a 'car', you have to provide one to your buyer.
