disable family memeber ownes the house but fully aware of his surroundings and mine. but the brother is incharge of his money. does the brother have the right to say who can live in the home. the will states only the diable son ownes the house.

The owner has control, unless he gives power of attorney to someone who then also has a say, or agrees with the actions of the person. If you think you need to contest the arrangement in the best interests of the disabled family member to protect them from financial misuse, it probably requires you to seek guardianship or conservatorship.
