Legal Question in Civil Rights Law in California

Lawyer owes me money

I was in a lawsuit two years ago. I won and received a lump sum and the rest was to be in payments. My Lawyer payed me the lump sum but still owes me the rest in payments. I've tried to call but he doesn,t take my calls. I have also sent numerous certified letters but he will not respond. What do I do to collect the rest of the money that is owed to me.

Re: Lawyer owes me money

Have another lawyer write him a letter advising him of his fiduciary obligations and his violation of the Rules of Professional Responsibility. If that doesn't work, then you can report him to the State Bar, which jumps on these kinds of cases.

If your lawyer has actually received any payments due you and hasn't paid you your share, then he is at fault, and you should contact the State Bar to complain.

If he hasn't received any payments, there isn't any money to pay you. He should, however, respond to your inquiries and explain the situation. It sounds like he thinks there is not going to be any more money paid, and has lost interest.

You can hire another attorney to try to collect on your judgment the same as anyone else would, by trying to obtain a Writ of Execution on your judgment and trying to locate assets to collect against.
