Legal Question in Civil Rights Law in California

Ownership of an auto

Hello. Two years ago, I used my credit to buy my boyfriend a mercedes. We have since broke up and I do not want the stress of checking to see if he is making the car payments. The car is registered in his name but the loan is in my name. Can I legally take the car away from him? What are my options?

Grand Theft Auto is not a felony you want to defend. Unless you can get him to refinance the loan in his name, you're stuck with the consequences of your decision, as always.

No. Ask him if he and you could contact the lender to refinance the car in his name only, or that he take a new loan to pay off what you owe. Since you are not on title, and because he might have made some payments, you could be prosecuted for theft if you were to take the car.

You can always get a copy of your credit report or even contact the lender for an accounting, since the loan is yours. Perhaps arrange with the lender for duplicate monthly statements. Good luck.
