Legal Question in Civil Rights Law in California

Private Property Arrest

Did the Officer have the legal right on private property to interagate me,about the avocado's in my car & take them when he left, then come back 6 hrs later, and arrest me just to give me a ticket at there substation.

I was asked to transport some avocado's for a guy, that claimed he was lic to take them to market. I thought it was all legal. I had the avocado's in the back seat of my car on private property. The Officer's were looking for someone & happened to notice the avocado's in plain site in my car. If I thought it was against the law I would have hid them, but I didn't know. I was woke up by the officers asking me why I had all those in my car, and was I lic. to have them. My ignorance about the law & the limit to how many pounds you can legally have in your postion. The officer's took the avocado's when they left that morning. About 6 hrs. later that day the Officer comes back on the property, and puts me in handcuffs just to drive me 25 minutes inland to give me a ticket, and take my pic. The other guy that had explain to the Officer about me just doing a favor for someone had a warrant & a 2005 tag on his van that was illegally, and they did nothing, but arrest me.

Re: Private Property Arrest

You can raise your facts in defense of the charges in court. If you want to get legal counsel to minimize the chance of conviction, feel free to call. Make sure your 'friend' doesn't disappear on you, his testimony will be required.
