If serving is not valid what are the probabilities that the judge will throw out the case

Zero. You may specially appear through an attorney to contest service. Ultimately, you will be served and have to answer. If you don't contest service and/or don't appear in the case, you'll soon have a judgment against you.

None. Defective service must be challenged properly by motion to avoid a default judgment against you.
