Legal Question in Civil Rights Law in California
Refusal to pay for care
Kaiser Permanente implanted a
Medtronic Intrathecal Device in May
2004. It allowed me to get out of a
wheel chair. It is a work related
injury. It was paid for by the doctors
who own Kaiser not my health care.
On November 9, 2008 the pump
began beeping alerting me that the
medication was running out. Leading
to a potentially life threatening
condition. I began to experience
severe withdrawal and had to go to 2
ERS. Kaiser refused to manage the
pump on 11/9/08 telling me ''You are
on your own.'' The Co who makes
the pump assisted me in finding an
MD who would fill the device avoiding
a potential of Cerebral Spinal Fluid
entering the pump because of the
lack of medication. This is the life
threatening issue Kaiser created. I
have filed with the state of CA. Kaiser
refused to expedite my request. Off
the record the State instructed me to
hire a Civil Litigation Attorney. Do I
have a case?

Re: Refusal to pay for care
As you may know, some Medtronic Intrathecal Devices have been subject to Class I recalls (the most serious). Typically, problems occur because the device was improperly implanted. More information would be needed to determine if you have a case. If you would like to speak to me about your situation, please feel free to contact me.
Yours truly,
