Legal Question in Civil Rights Law in California
Release of funds from a cd account
My daughter and I were involved in an accident when she was 3 years old. Now we are ready to withdraw the money that was settled back then. Now the bank will not release the funds because I do not have a court order and a pleading form. I am low income and I don't know where to start. Can you give me some advice? Will I be charged fo this?

An attorney will charge you to help you, yes. The court will probably approve and set the fees as part of the process of approving the motion and request, and allow payment from the trust funds. This assumes the trust funds are substantial. If you don't know how to do this, you need an attorney. It involves filing a Petition and supporting documents and declarations sufficient to convince the court to approve use of the funds. She must now be 18 for this to happen, unless this is an emergency need. Feel free to contact me if interested in getting the help.

What county was the judgment entered? Why don't you contact the attorney that obtained the judgment for you? If he is unavailable contact me directly.
