my rights as caregiver/daughter
im my parents youngest daughter/caregiver. ive been solly taking care of both(elderly) since the end of 2005,with not so much of a break at the most a couple of hours, cause they call me on my cell ''where are you ect.. I dont get state asst. cause they own their home, yet they have a 30.000,morg. and my parents were always good about bills but they took morg. out to pre pay for their plots... but they put my sister the oh so perfect one that just sold apt. in Burbank probly half a mill, but want my parents to sign the rest of everything into her name, she does nothing in care for them 2 brothers dont even call on x-mas, they dont not particapate in their care i do all, and have docs to prove,but im adopted and mom spoiled me, (not my fault), but theres nothing with my name in writing and wether im right or wrong about how things will get divided,still want to protect myself, Dad has already signed one paper and doesnt relize what he signed and DNV is comming to our houstoday to get my mom a updated id so i think so she can sign the paper that my sister is trying so hard to get. since when does the dnv nake house calls, sis is a head honcho for AAA, shes pulling strings and im the fool not so perfect history, they will use that/me

If your question is 'what rights to the estate do you have?', the answer is that you will have the ability to contest in a probate proceeding any property distribution that improperly omits you, or any Wills and trusts that you allege were unduly influenced by others. If the parents are no longer competent to care for themselves, you could now seek a conservatorship over them and ask the court for authority necessary to control their finances, to prevent further problems and takings. The attorney handling the conservatorship can get paid out of the parents' funds and estate, assuming they have one. If not, he gets paid by the conservator applying.
