His insurance has nothing to do with it, and you can't sue them, only the driver and registered owners. If his insurance fails to pay what you will accept, you can sue, as long as you think you can prove liability and sufficient damages to justify the investment of time and money it takes. Nothing is 'owed' to you unless you prove it in court.
