Legal Question in Civil Rights Law in California

vandalism, now what?

in a moment of rage in response to a personal insult, i vandalized the windshield of someone\'s car. I quickly regretted it & offered to pay for the damages. The person then harassed me to the point where I changed my phone number, gave me bogas receipts and demanded more than 3 times the actual repair cost for his pain and suffering, saying if I didn\'t pay he\'d sue. Now (2 weeks later) he is suing me for $2000, although the actual cost of repairs is 3/4th's less. I still intend to pay, but believe this person is trying to extort money from me that he isn\'t owed. What now?

Re: vandalism, now what?

Now you defend the lawsuit.

In addition to his actual damages, he will probably seek compensation for intentional infliction of emotional distress. This can more than account for the extra $1500. You'll want to show that he hasn't been that distressed over it.

I think you should see a local attorney soon. Look at the summons you received for the deadline to file your Answer. You should see your lawyer well in advance of that date.

Good luck.

Defend the suit. It is in small claims, where you get to speak without an attorney. Tell your story and request proof of expense.
