Wage Garnishment

I am being thrawtened--name removed-- wage garnishement from a civil suit in ILL. i live in Ca. can the person do that? Will I have a chance to answer in my court as the ILL. court has no jurisdiction over me. can someone have my wages garnished on a small civil out of state judgement?

If the circumstances are such that it was unreasonable to sue you in IL, for example a creditor or collection agency engaged in "distant forum abuse," your lawyer could apply to the court for an order prohibiting collection of the judgment in California, and you could even sue back for unfair debt collection practices. But I am speculating, because you didn't say what kind of case this is, or how long ago the judgment was entered, or whether you used to live in IL, or whether you appeared in court in IL and lost or it was a default judgment.

You can contest the 'enforcement' of a sister state judgment where someone is trying to collect and levy on you in CA. There are some procedures available to 'fight' that levy. If that is the case, and it is in SoCal courts, feel free to contact me for legal help.
