is ungerage dating legall????

im a 17 year old female. im about to turn 18 on oct.7 of 08... im dating i 18 year old guy whos turning 19 on feb.20 of 09. can he still go to jail for dating me?? my mom is trying to do everything she can to put him in jail. she doesnt approve of me dating him. wat can i do to help him not go to jail? we havent done enything wrong!

There is nothing illegal about an adult dating a minor, but sexual contact -- which does not necessarily mean intercourse -- between them would qualify as statutory rape (though that is not the name California uses for the offense). No matter how much your mother disapproves of the relationship, she can't get your boyfriend jailed without proof that you and he have had sexual contact. Even with such proof he probably would not be prosecuted unless he is already in trouble with the law for other reasons.

The good news is that you won't be a minor anymore once you turn 18. This doesn't mean adding sex to your relationship will be wise, but it does mean it will be legal.
