Legal Question in Construction Law in California

California Lien Release

Is it an absolute requirement of the Statute that the #1 & #2 Releases include the actual dollar amount of the release or is it permissable to simple note: Paid-in-Full

Re: California Lien Release

You really only need dollar amounts in the lien releases when you want to release portions of the lien, but not the whole lien.

Say you've got a lien for $100,000 and you have received final progress payment but not final retention. You might release the amounts of all progress payments by writing in the $90,000 or so that you've received, thus leaving the other $10,000 by implication.

When you get your final retention payment, you can then execute a full lien release by writing "full" or "full release of all lien amounts and claims" or some similar term.

Remember to execute it in front of a notary public.

Email directly if you need clarification. Good luck.
