I am being sued. The attorney that represents the plaintiff, gave me a legal advice on a another issue, prior to the law suit. Can he still represent the plaintiff

In order to get rid of an attorney, you have to file a motion for disqualification. Your query does not say the nature of the prior representation. Did you retain the attorney? Or was he simplly answering your questions? Your query also does not state whether you are representing yourself. If you are, you have to file the motion. The attorney can undoubedly defend himself, on the ground that in the previous representation, he was not your attorney and/or you did not provide any confidential information relating to the present case. Is that true? That will detemine the chances of your motion being granted. A motion for disqualification is, therefore, a strategic matter. Is it worth the time and effort? The main thing are the facts. What precisely was the previous contact with the attorney?
