Legal Question in Construction Law in California

Contractor breaking Contractor's License Laws

What kind of consequences could our licensed contractor face from CSLB for failing to meet several requirements that should have been included in our home improvement contract?

Could he have additional consequences or penalties imposed by a judge if we end up in a lawsuit?

To name a few:

No start/completion date (verbal agreement only).

No notice that owner has a right to require performance & payment bond. No Mechanics Lien warning.

Half of the requirements a contract should include were not met.

Re: Contractor breaking Contractor's License Laws

Failing to meet the requirements for contents of a home-improvement contract is cause for discipline of the guilty contractor by the CSLB.

However, the severity of the discipline (and indeed whether the CSLB takes action at all, even though it should) will depend very much upon the harm done to the homeowner by the omissions.

If the contract were performed without significant adverse consequence to the homeowner, the CSLB, which is very busy, might be inclined to shrug it all off, especially if the contractor has no previous record of discipline.
