Legal Question in Construction Law in California

Employer, a contractor failed to pay wages.

My husband's employer failed to pay him 12 paychecks. Now laid off. Should we lien the employer-contractor or their customer, Shea Homes?

File an unpaid wage claim with the Labor Commissioner. You don't have the right to file a 'lien' unless you are a contractor making a labor or materials supply claim, and followed all the notice requirements. If you want legal help in this, feel free to contact me.

As a laborer for wages, you have the right to record a mechanic's lien against the property which you worked to improve, without having to file a 20 day notice. The lien must be filed with the recorder of the county in which the property is located, and must be filed within 90 days of the project completion. further, a lawsuit to perfect the lien must be filed with the court within 90 days of rcording the lien. I don't know how much is involved, but you should consult with a qualified attorney. Best of luck
