Garage without permits

after fifteen years since we purchased our house, a building inspectors told us that our garage was built without a permit. We tried to get the permit but now the city wants us to reduce the size and tear down half of our garage. this is major construction work and money that we don't have to do all of this work.

The statute of limitations will be difficult to overcome. Consult with local counsel to see if there is any way of bringing action against the seller, based on your contract, facts or evidence of fraud.

Once these enforcement actions get under way, they tend to have a life of their own and preventing the city from carrying out enforcement gets more and more difficult and less and less possible as you attempt to resist. I recommend getting a good local attorney with a substantial code enforcement practice to advise you as to whether there is any realistic hope for a variance or abatement short of reconstruction. Do this as soon as possible, the situation is more likely to worsen than to blow over.
