Legal Question in Construction Law in California

non payment

I finished a job in October and the client swore he would pay in a series of payments so I said OK. He has not made one since then. I have written him several times and with no response. What should I do

You have several options assuming of course that you are a licensed contractor. If you are not, then you are out of luck.

First, assuming the project has not been completed even though your respective portion was completed in October, you can file a lien against the property. After that, you will have 90 days to bring a foreclosure suit against the owner.

Secondly, you can sue for breach of contract. Assuming more than $7,500 is at issue, you will do that in 'regular' court. If it is less, you will need to file in small claims.

Either way, if your company is a corporation, you will need a lawyer to bring suit.
