Legal Question in Construction Law in California
SB 800 Information With New Home Problems
I bought a new home and upgraded my flooring throught the builders design center. My new hardwood floor was installed by a sub-contractor. The floor is coming apart and needs to be replaced. The sub-contractor after months of calling them has agreed to replace it. I recently spoke with the contractors board and they sent me information on SB 800 the ''Fix it'' legislation. Within SB 800 it states that for every notice of claim to the builder, the builder must allow the homeowner 3 alternative quotes to fix the problem. If a different company fixes the floor, then it is between the builder and the original sub-contractor on who is going to pay for it. My builder has never offered alternative quotes on any of the work that has needed to be done. Am I in the right to demand it? I really don;t want the original sub replacing the floor, as they did an awfull job the first time. Please Help.

Re: SB 800 Information With New Home Problems
You can ask for anything, and can negotiate for anything. If the sub agrees, no problem. If you think you will end up having to sue, then you should consult with an attorney now to make sure you are doing the right things at the right times. Contact me if interested in doing it right.
