Generally, sellers are responsible for the smog and can not transfer that obligation to the buyers. However, vehicles older than a certain age are exempt from many of the emissions requirements. 1981 sounds like it is old enough. Do a quick check on the DMV website frequently asked questions rather than wasting your money on a lawyer for this relatively easy question to answer yourself with a little research.
