Condo developer misrepresented man door in garage

New condo development model is a 6-plex unit;some of the development contains 3-plex units (6-plexes divided in half with a small side yard between the two 3-plexes). All brochures depict the 6-plex with NO reference to a triplex. We have signed documents from July 05 and Dec. 05 depicting a door from the garage to backyard. During construction in Dec. I inquired why no door was framed in garage and told triplexe have side yards instead. This was never told to us and is contrary to documentation signed. Have written docs from builder apologizing for the ''misrepresentation''. During final walkthru, I requested builder put my doggy door through the wall if I was not to get ''man door''. They refused. We closed escrow 4/7/06. My view lot has only a sliding door for access; our50#dog must use a panel doggy door reducing my access to backyard by 10-12 inches=free reign to the entire house for my dog. Cannot confine her to the garage side of the backyard;security of my home is now compromised;cannot install a motion detector. No garage access was never disclosed to me;new docs to new owners have been prepared because of my problem. I am well documented;they fouled up; need doggy door and compensation for their bad faith/attitude

Any lawyer would love the letter from the builder admitting his/her "misrepresentation." It sounds like you might have a case for the cost of your having to put in the doggy door yourself, let alone not having the access or yard that you thought. Bring your papers to a lawyer in your area for a consultation about these issues.
