Legal Question in Consumer Law in California
Contractor took deposit, delayed work then filed bankruptcy.
Contractor took $2700.00 deposit but apparently did not order windows, then made excuses to delay then sent a form letter to contact their attorney who said he has been retained in Chapter 7 bankruptcy. Contract indicated completion of work would be approx. 30-40 days but letter was received 49 days after deposit was given. Attorney said they have no windows (which means they were never ordered from factory) and they have no assets. Also bankruptcy will be filed ''within a few weeks''. What to do? Thx.

if the BK has not been filed yet you can go to small claims court. otherwise, get in line behind the other creditors. If they had a bond you might be able to go after that.
