direct deposit are you legally obligated to give money back when your employer over pays you

If it's a true overpayment, then you owe the money.
Some employers ask job applicants for written permission to suck money back out of their bank accounts if they claim there is an overpayment. I would not sign such a paper.

You are obligated to repay the money. The fact that you received it via direct deposit is not relevant.
