Legal Question in Consumer Law in California

Items received via US maIL

One of our credit cards (AM EXP) insists on sending us books which we do not want. They send a postcard prior to mailing the book which we must respond to if we do not want the book-which we do. A call to Am Exp requesting they stop this ''service'' results in Am Exp denying they know nothing about any mailed book. Are we within our rights keeping the book since we did not request it and even tried to prevent deliveries by telephoning the company?

Put it in writing! Send them a certified letter telling them you never ordered the books, and they should provide for their return postage. Set a reasonable date for a response. Also, dispute in writing (mailed to the Billing Disputes address) any charges that show up on your AMEX bill. AMEX is usually very good about resolving customer disputes.
