Legal Question in Consumer Law in California
I made a purchase of two pictures with customized frame at LIK VENETIAN at Las Vegas.
I asked a question on Aug. 15, 2011 the possibility of returning the pictures and got 80% rerun
for several reasons as explained before. Thanks for the answers.
Answer 1:
"You may have to have a lawyer read the contract very carefully to determine what rights you have.
It is not possible to understand what exactly you paid for and what you got, without seeing the entire contract. "
I copied the related part of my order form is copied below.
Customer Order Form
Name ...
Total $5479
Framed artwork: All 4-6 weeks for delivery
Lay by payments: All deposits are non-refundable. Balances are due in 90 days. Minimum 20% deposit..
Unframed art work: Subject to reprint fees if brought back to be framed.
Custom artwork: All sales are final. No refunds.
Answer 2:
"As a first step, and assuming that you made the purchase on a credit card, you can dispute the charges with the credit card issuer. The issuer will not resolve the dispute for you, but the transaction will be put on hold pending a resolution."
I asked credit card company to dispute payment after I saw this answer.

The contract says that "all custom art work is non-refundable". If your art work is custom, then the contract says it is not refundable.
Good luck with the credit card dispute. Now, stop buying overpriced tschotskes in Vegas. Every other day I go to the garage and I have to look at the 3-foot-tall gold leaf statue of Nefertiti she bought at the Luxor, so I feel your pain. For better value, you could bet $5000 on the pass line. If you must spring for stuff like this, for goodness sake take a photograph of your purchase before you have it shipped.
