National Do Not Call Registry
Hi. I am a real estate investor in California and have a question about the National Do Not Call Registry. I am interested in cold-calling individuals whose homes are in foreclosure. The purpose of my call is to offer to buy their home. As I see it, I am only offering to “buy” their asset, and am not trying to “sell” them anything. Since I am not trying to “sell” them anything, must I refrain from calling people on the National Do Not Call Registry.

Unless you like being sued, don't do it. They already get dozens of mail pieces and unauthorized calls. I have even heard of bottom feeders like you contacting the neighbors of the people and obtaining a return call on the pretext there was a family emergency. Again, I would love to represent a foreclosure debtor in such a circumstance.

I think you have a fundamental problem with your question. Before you even think about doing what you suggest, you better know how to purchase homes in foreclosure. There is an entire body of law that must be precisely followed and, if not done correctly, you could be criminally prosecuted for even an innocent violation of the law.
