Legal Question in Consumer Law in California
Personal Dispute
I was engaged over a year ago, unemployed, my Fiance took on my debt, stating to relieve my stress level as I was living on my Credit cards. We broke up. He is now constantly harassing me regarding this. I have given him some money, but do not have any to pay him right now. I had stated that when I do, I will. This is a large amount. He said he only helped me now because we were supposed to be together. Now he said its a loan. I just dont have it. It is from 60k to 47k. now. as he puts it. My question is, can he come after me legally? I'm not trying to hide, but cannot handle this constant verbal, and last week physical abuse. I just do not have this money at this time. I still have debt am raising a daughter, dont even have my own car. What type of attorney can give me counsel? Thank you.

Re: Personal Dispute
If he is or has physically abused you recently, you may get a domestic violence restraining order at your local court.
Regarding the debt, it depends what your agreement was -- i.e. whether he agreed to take it on as a gift to you at the time, or whether it's a loan. The fact that you have paid him something back suggests you believe it was a loan. If a trusted intermediary can't negotiate with him, then he might attempt legal action. In that case, you can consider Chapter 7 bankruptcy depending on your entire financial picture.
As an aside, sometimes exes use things like this to get the other's attention, even if it's in a negative way.
