spam lawsuits

according to recent legislation, spammers can be sued for unsolicited email if they do not provide a method for removal from potential consumer lists. these lists are bought and sold in the open market. once an email address is targeted, it will be sold repeatedly to other spammers. what course of action can be taken to be removed from all lists, or, to punish the list distributers/offenders?

I know there is federal legislation allowing you to sue somebody who sends you an unsolicited advertisement by facsimile. I do not believe there is any legislation so far regarding spam e-mail.
