Legal Question in Credit and Debt Law in California

I agreed to pay an outstanding debt to a collection agency in the form of payments with the understanding I would not be sued as long as I made my payments. However, a couple of weeks after my first payment was made, I received a summons for this same debt. My wife talked to the agent for this agency and he told her that at the time I had made the agreement with him for the monthly payments, they already knew they were going to sue and just wanted to get me to start paying. Now, can I sue them for violation of the Fair Credit Act? As they made a verbal contract with me to allow me to pay in payments and they made this agreement with no intention of allowing me to honor it, in other words in bad faith?
