Bank Levy - Claim of Exemption

Last month I had my checking account levied from a creditor with a judgement. The account they levied is the account used for my spouse and children's direct deposit for Social Security monies. I filed the claim of exemption and waited the 15 days for an answer from the creditor and they did not respond the claim. How do I get my money back??

Assuming that you filed the appropriate paperwork, the sheriff's department will notify that bank that the levy has been released. If the bank already transmitted it to the Sheriff's Department, they should release the money to you in a few weeks. These things time...that's county government for you.

However, you should contact the Sheriff's Department just to be safe. Make sure you speak with a live person and get confirmation that they received your claim of exemption.
