Legal Question in Credit and Debt Law in California

Bank Levy

I have a judgment against me. The creditor levied my savings and checking account. Can I claim an exemption. I need this money to pay for my bills. My savings account only had $200. in it; my checking account had @$800. What are my rights?

Re: Bank Levy

Yes, you can make a motion to the court to exempt any of that money which may fit under any exempt category. You can also make a motion to that the money is needed to support yourself. This motion is considered based on financial need. It will not prevent them from collecting the money from you, but it may reduce the amount they can be levied at one time.
