What if opposing counsel does not

appear for the case management

hearing? Does the judge dismiss the

case?

No. Judge might simply set dates and doi nothing. May set OSC, may fine attorney. Most likely, do nothing.

The judge will not dismiss the case. However, the judgment might set an Order to Show Cause hearing regarding possibly sanctions that might include dismissal and reschedule the CMC. Most judges will give the attorney an opportunity to explain the faiture to appear before making any decisions. However, dismissal at this point is highly unlikely.
