Legal Question in Credit and Debt Law in California

Re: debt

My mother hired a agency who was

suppose to negotiate her and my

debts (she had me use my card to

purchase things) with the credit card

companies for a lesser amount.

The company has failed to do so and

now I face a summons in a week and

a half cause the card was in my

name. My mother said she would

take care of everything and the

company she hired said they would

take care of the credit companies.

The summons that came was not

served but mailed and as I have

been out of the country I just

recieved it. It was filed April 17 while

I was away.

The only thing the company

consolidation said was that they

faxed a paper for me to apply for

arbitration.

I feel the company has screwed us

and that while my mother said she

will pay the debt that this company

settled for obviously they haven't so,

I am left with a summons and I am

a student with no money. What do I

do? I need help urgently.

Do I try and settle with the credit

card company myself and my

mother will make the payments

or do I do bankrupcy. My wife is also

a student.

I was told they can take my car and

anything I own and when I do start

work then I will be working for

nothing as they will take my wages.

You should consult with a bankruptcy attorney, if you think you may qualify. If you do not qualify, talk to an attorney about representing you in the lawsuit and trying to negotiate the debt.

I provide bankruptcy services in Northern and Southern California. If you do not want to do a bankruptcy, you could respond to the complaint within 30 days of service (i.e. ASAP), and also cross-complain against the debt management company.
