should i file in small claims court now or wait until the total time is elapsed for the payment of a loan terms to expire.

If you have good reason to believe that the debtor won't pay -- such as an e-mail from the debtor that tells you that -- then you can file a small claims lawsuit now for anticipatory breach of contract/agreement.
