Legal Question in Criminal Law in California
In 2004 I was arrested for prescription forgery, Subsequently I was given a very light sentence of a drug treatment program which required me to pay a fee. Unfortunately O am a Disabled person and recieve SSI and the cost was too much for me to pay all at once. A few months later just short of me having completing the classes successfully, because of my inability to pay the entire amount in the time they gave me, a felony warrant was put out for my arresst. Long story short, I got back out of jail on bail that same day I was arressted on that warrant. I then immediately went to the people in charge of the drug treatment facility and explained my situation of the inabiity to pay. Shortly thereafter they waived my fees and I completed the class successfully and went back before a judge and had my case dismissed. Recently I applied to do some police ride alongs and found out that because I was arressted on a felony warrant that I was ineligible to participate. I reside in san diego california and My real question is, if my case was dismissed, why is there still this lingering problem of this felony warrant even though the case was dropped. And do I have the right to go before a judge and ask him/her to amend mycasr dismissal to include the removal of this felony warrant issue from my record which I should not even have. I was assured that all the charges and so on once dismissed, I should have no problems incurring employment or in this case being able to participate in something any other citizen has the right to do. Can you answer my question please.
