Legal Question in Criminal Law in California

1203.4 dismissal insufficient...

I had a 314.1 conviction following a Christmas party in 1986. I represented myself (IDIOT!!), and fully cooperated with the D.A. and the probation department, promptly leading to a conviction.

I left teaching in 2001 to return to the military full time. HOWEVER - Now, no school district will hire me due to the conviction. How the @%#)%@ can I get this removed from my record?!? Thanks!!

You may be able to get a certificate of rehabilitation. This will not remove the conviction but should be enough to help you get a teaching job.

If an expungment under 1203.4 and the resulting dismissal is 'insufficient', then you are probably out of luck. Dismissal is dismissal, no longer a conviction to be used against you.
