Legal Question in Criminal Law in California
11351-Possession/Purchase
My husband plead guilty to a section 11351 in 2000 and was given 58 days in corrections facility (not prison). Recently we had this conviction expunged (PC 1203.4). The question is not whether or not he can carry a firearm for hunting purposes?

Re: 11351-Possession/Purchase
Not unless he likes the thought of prison. Any felony conviction makes him a 'prohibited person', barred from so much as being near a firearm or ammunition. If found in possession, it is a state and federal felony with mandatory jail/prison time. Expungement does NOT restore his rights. If he wants to try to restore them, contact me to discuss the potential and costs of doing so through appropriate court motions. 2nd Amendment rights issues are one of my specialties in criminal law.
