I have a 14 year old son and we live with my boyfriend and his two boys. my 14 yrs old got caught spray painting on city property and recieved a ticket on 1/26 along with my boyfriends younger son.
On 1/30 I was called to the school to pick my son up because more damage was found on school property he carved his name in wet cement and my boyfriends older son who is 16 was with him and also carved his name they are being charged with a felony how does the court devide the responsabilty for the damage. Is it advisable for me to get a lawyer for my son.

First issue is whether the acts qualify as a felony, second, even in juvi court substantial penalties apply, vandalism carries several collateral consequences aside for jail/fines/probation,next, restitution is joint and several, meaning each is responsible for everything, the victim is entitled to recover only once. Counsel is needed ASAP

In these criminal matters, it is always advisable to have an attorney with you to help protect you or your child's rights. Although it may not seem like it, the other child and your son do not probably have the same interests in this matter.

A felony carries substantial prison time, even for a juvenile, and he has now established a pattern of this behavior that the DA and judge will look at. You decide whether you need an attorney. Feel free to contact me if you decide to get legal help, and if the case is in SoCal.
