Legal Question in Criminal Law in California
about 9 years ago i borrowed a large sum of money from my mom. she asked me not to say anything to my brother about it. well a few months later my brother found out about it . and had her declared incompident. my brother called police and realised i wasnt lying my mom indeed let me borrow it. well he sold my moms house place in a home and asked me to sign off trust. and i did with him promissing me not to take it out on my mom. well since then my mother has passed and my brother as well. my brothers wife didnt inform me and took over trust. now 9 years later the district attourney is trying to proscute me. my family is gone my mother is not here or my brother. what legal rights do i have my sister in law sent me some money leftfrom the trust and gave more to grandchildren and her family , then the trust stated. i let it go. but i need to know can the state of california still presue this ?

"Trying to prosecute"??
If that means they have charged you with a crime, you have a 'right' to hire an attorney to fight this. It sounds like the statute of limitations would have run out years ago, so I can't understand what they would be 'prosecuting'.
You need to consult with a local criminal defense attorney immediately, and take the standard legal advice to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney.
